The company i work for, i think are trying to sack me.?

My department are doing an investigation on me to why i didnt fill in a purchase order for work i got a contractor to do. I havent been made aware of policy in regards to how we work with contractors. There have been a number of other occasions where other people have not been told the correct procedures in regards to using the purchase order, however the department havent investigated them. Now the contractor wants payment for the work done and i know the company will pay. But i think the company are using this as a way for getting rid of me. If they company decide to sack me have i got good ground to sue them? What are my rights and what can i do.

If you broke the company's rules, even through ignorance, then you can't sue them for sacking you - you are in the wrong. I work for a small private company and if they ended up being liable for a large unexpected bill then the whole company could fold and we could all lose our jobs, so it's really important to follow procedure on this stuff. Also if you do not have a paper trail for purchase orders, other contractors can get the impression that you are just passing business to your mates.

Pointing out that other people have also broken the rules is a bad idea - two wrongs do not make a right.

The best bet is to co-operate with the investigation; be honest and apologetic; assure them that it will not happen again; and hope that you get to keep the job. If the rest of your work is good they will not want to lose your skills and experience.
It really does depend on how long you have been with the company. And gather as much evidence as you can that shows how other people have done the same as you, you also might have a good case for unfair dissimal if you can prove that you had received no training in this area and it was not on you job description. When you are being investigated it is an enquiry into the circumstances, to fully determine what the situation is. You must remind them that at no point did you receive the training required to complete your role fully. If you were sacked an employment tribunal would throw it out as there is no evidence to show that you have been trained in this way. If there is a union where you work make sure that you are a member and involve the union from the very start of any procedures. If you have no union on the premises see your personnel manager and ask what union is recognised by the company you work for. If the union fails then I would seek advice from citizens advice who will give you all you need in order to fight your case, that is supposing there is a case to answer for. If your company are trying to get rid of you they need to give you formal notification, a verbal warning (and they need to tell you that's what it is) and a written warning. If you received training on when to fill out purchase orders then they may be standing on ground but the question of getting rid of you lies in how much time you have worked there and what kind of contract you are on ie temp or perm etc. Your best bet is to contact a solicitor and find out or your union if you have one. Try talking to The Citizens Advice Bureau as a first port of call. Don't panic though, keep up working and don't let the bstrds get you down.
Create a dossier of other people who were in a similar position to yourself. Collect witrness statements to the effect that they followed the same process that you have. Then ask your employer why you are being treated differently to everyone else.

Write down everything that has lead up to this. Start to keep a private journal in a note book about everything that happens to you at work. No one sees it but you. Don't have it be online, you don't want your bosses to see it. Call the help line for the Department of Labor in your State and get advice. Consult an attorney.

Why would they want to specificly fire you and not others? Why are the other people exempt and not you?

Did they tell you in advance that incorrectly filling out this paperwork was grounds for dismissal?
Keep a diary, of everything said to you, memos, everything, because if it ends up getting nasty you really need to be clear on who what and when, and if it is written down they will find it harder to claim you made it all up after the date.

Don't let anyone wind you up, peronnel will often try to get you to say something silly or quit. Becareful about notetakers, one trick they use is to have a meeting and bring in an allie who will only record the bits they want recorded, borrow a dictaphone, keep it handy for such instances, ( you should really tell people if you are going to record them), Meetings have been cancelled once recording devices have appeared.

Get really clued up on your contract. employment law that relates to you, and the Ombusman.

Get details on the other similar cases, check your training record, get a copy made.

If they want you out they will get you out, and fighting will probably alot of hassel for very little reward, start thinking about all your options, ie an escape route, you will not be very employable if you are sacked, and you will be even less likely to be employed if you take your current employer to court. (Its not fair, I know, I have been there, look at all your options)
