Re Council Tax benefit - continued receiving HB & now to meet 2 investigators in a taped interview what'll hap

I stupidly/lazy didn't notify CT of a change in circumstances (better job more money) - I don't dispute repaying the money £500.00 but they still want me in for an interview - what can I expect. I used to work in the CT department (for a brief 3 months) so should have known better but I just never did anything about it expecting a new form to be sent to me at which point I would have clarified my situation - advice please

I would just tell them the truth, if you try and lie and deceive your way through this they will just throw the book at you. Tell them you were awaiting a form, but realise you should have informed them and realise you have made a huge mistake and apologise. If they think you did this as a one off and you are basically an honest person you will probably get a warning letter. Good luck and remember we all make stupid mistakes that we live to regret.

Unfortunately it is up to you to notify them of any changes in your circumstances, the defence that you were waiting for a new form will not work with them. They have asked you in for an interview to determine a) Whether you deliberately tried to de-fraud, b) How long the change in circumstances has been applicable. I would suggest that you either contact Citizens Advice Bureau or a Solicitor for legal advice.
There is a good chance that your case may end up going to court.

my mate got called for an interview when someone bubbled her for cash in hand work but once she explained her situation and that she was actually collecting the work for someone else nothing more happened. just tell em u forget, easily done!

You will be interviewed under caution to determine whether or not you have acted fraudulently. A written record will be kept of the interview and you will be asked to sign the record as a true statement of the facts. You are not under arrest or obliged to answer any of the questions without seeking advice. You can have a friend with you during the interview for support. You may terminate the interview at any time in order to seek professional advice (Citizens Advice, Law Centre, Welfare Benefits/Rights solicitor etc). When you signed your initial claim you agreed to inform of any change in circumstances immediately said change occurred - in law it is your responsibility to request a new form as soon as you know of a change in your circumstances, ignorance is not a defence. It is unlikely that you will be prosecuted for fraud as this is a very complex and expensive action, however, the Local Authority will reserve the right to prosecute if they think there is a chance that they will be successful in such a prosecution (and, more importantly, it is a good use of taxpayers money). Do not worry, tell the truth and seek appropriate advice.
A telling off & possible court action if the relevant council feels like it, if you are genuine, your details will be on file in case, it happens again, then the book will be thrown at you rightly so.
