If you phone in sick can the company legally phone you back when your shift is due to start?

Even if you have told them what is wrong with you when you phoned the night b4?

I'm an employment counsellor and I've studied Employment law and it is perfectly legal for them to call you the next day if they choose. But, the thing is you may not answer because you may be in bed sick or at a doctors appointment. They can not assume that you are not sick.that is illegal and harassment.

They are not supposed to phone you, they have to wait for you to get in touch.
i think they can as if anyone calls in sick in my job the boss phones them to make sure there at home and if they say they were at the doctor he wants a note

YeAH its legal,but they can only phone to see how you are? and to see if they can help you in anyway?and thats how the get round the law other wise it would be bullying you back to work. then you could sue..
You're not legally obliged to answer the phone or even be in the house when you're off sick. If the phone rings just ignore it or get one of those that shows the callers number.
Yes it is legal for them to call you. However, if you don't answer the call they cannot sack you for deception. You have every right not to answer a call, after all you may be too ill to come to the phone.
Sure they can call you, but if you are still sick what are you going to do?

Common courtesy says you should try to give your shift lead as much advance notice as you can if you think you are going to miss a shift, this way your lead can scramble to pull in a replacement. If the shift lead calls you back is not to mess with you, it is probably because he is hard pressed to find somebody to cover your shift.
