My friend got caught drink driving?
what will she get in court ?
she has never been in trouble before with the police
will her insurance pay up or will they refuse because of the offence
no one was hurt
Answers:
I work for an insurance company - they should pay up as being caught drunk / refusing to give a breath test is not sufficient grounds for them not to deal (unless it is expressly mentioned in her policy booklet) If found guilty at Court, she is likely to recieve at least a 12 month driving ban, a fine of 200 pounds and about 6 points on her licence. She will strugle to get insured afterwards though.
Oh what a silly cow!
I don't know about the insurance - but I hope they throw the book at her in court. She deserves everything she has coming to her.
I think she will lose her license.
The insurance should pay up
In Minnesota, refusing the test is the same as a guity plea and can add 90 days to the sentence. Insurance will probably pay and then either cancel or go high-risk.
Refusing to give a breath test alone is a fixed 12 month ban, pretty certain the insurance will pay for all damage, She will probably get 18 month ban heavy fine, unless she's loaded and can get a good brief on the case who would get her off? i should have added uk law.
She will get a driving ban a big fine and her insurance may well refuse to pay up. She will not go to prison though. Failing to do a breath test carries the same penalty as failing one and is viewed as an admission of guilt.
good they should through the book at her it is dangerous and irresponsible
Penalties are different in all states, if she refused a breathe test than she is admitting guilt. Tell me what state and I can tell you the penalties.
she'll probably lose her license, go to jail, pay a huge fine, maybe do some kind of rehab/community service. Tell her to get herself a good pair of Nike Run Flats. Stupid dumbfuck.
after going to a funeral of a child murdered by a drunk driver, guess the rest.
Minimum of 18months ban and may have to do a drink awareness course at end which she has to pay for. Also a very heavy fine plus costs.
She will most likely get her license suspended or even revoked. She will probably be given the option of fines or jail time. Her insurance will pay the damages, but she will probably get her rates hiked WAY up or even get dropped altogether. Some insurance companies have specific guidelines regarding drunk or reckless driving.
She'll get a stiff sentence, possibly custodial plus a fine - she may also be ordered to retake her test.
Not only was she driving 'under the influence' but then refusing the take the breath test, just made things so much worse.
Some insurance companies wont pay out when drink is involved, she would have to check with her company.
She was a bloody fool and was lucky no-one was injured - she deserves everything the court throws at her.
poor she.
I would of thought that your friend will more than likely get the following
1) 12 to 18 month Ban
2) heavy fine (reduce on appeal)
3) the insurance company won't pay up as driving under drink will invalid the policy, so your friend will have to pay the costs for repairs and anything else that comes with it.
4) I don't think she'll go to jail
If the above happens, she should count herself very lucky and should have learned a big lesson.
Oh and once she gets back on the road, insurance will rocket, if she can get some.
Oh well.
Sorry but no sympathy what so ever. You should not drink and drive.
Not too sure about the court though but it will be a ban for a while and then very heavy insurance for the next few years.
And for the cars she hit, if her insurance doesn't pay up which I don't think it will the owners will be able to take legal action to fund for the repairs.
In Kentucky the first offense you lose you license for thirty days plus court cost but where she hit the parked cars that may be another charge the insurance should cover the damage regardless of the crime committed.
If its her first offense, she will probably get a fine and points on her licence, she may lose her licence for a period of time.
Refusing to give a breath test was dumb. It points to guilt, therefore the police have no way of knowing how much over she was, therefore it will be up to the judge.
If she has been only just over the limit, the consequences would be obviously a lot less than if she was 5 times over, but as there is no way of knowing, the judge may well be able to sentance as he wishes, im not sure.
I hope she learned her lesson, that could have been a mother with kids she crashed into.
I hope she loses her licence, and has time to reflect on how stupid she has been.
Actually, she'll get a lot less than she deserves. I'd throw the book at her for the reckless endangerment of human life and I'd send her to prison for five years and ban her from driving for life.
My bet is that the'll give her a fine and suspend her license.
Whether insurrance pays up will depend on the fine print, but I imagine that all the other cars will be covered. If not she'll have a lot of money to pay out. And still she should count herself lucky!
The key word here is caught. She realizes that she did something very wrong or she would not expect the book that they will throw at her. I suppose she does deserve every bit of the consequences to her actions. This is a learning experience for her that will make a deep impression on her so continue to be her friend and help her along as much as you can. Let the experience be a teaching tool to you also.
Not a good move as I'm sure she realises now.
They will be quite hard on her, as they are getting very tough on drink-driving. There is so much publicity about it (as there should be) which has raised social consciousness to it's highest - people in general are really against it and that is also reflected in the punishment too.
She will be banned from driving for a period of time, I'm pretty sure.
Also insurance companies often have a clause that they will not pay out any claims if the driver is convicted of an offence that relates to the same claim. But she will need to read the small print - company rules may differ slightly.
I guess she won't be doing that again in a hurry!
No her insurance wont pay out she will get banned and have to resit her test again when the ban is up. i feel sorry for the other people who lose out their cars are damaged. I hope they ban her for years she deserves everything she gets good job im not the judge i would put her in prison she has no consideration for others. And could have taken a Human Life
you should tell her to be a perfect person in court and to not miss it, but i think she might not get any time though.
The insurance company will not pay up, because she was intoxicated! I hope that your friend has learnt there lesson.
For the sake of a fiver or tenner in a cab your friend would have got home safe!! Luckily for her no-one was hurt, but I hope that the owners of the cars don't want to claim lost of earnings because there cars were damaged because your friend could be paying out lots of money. Your friend will probably have a ban for 12 months and a fine because its her first offence.
if theres no need to answer, then what do u want us to do?
In order to drive legally, you need to purchase an auto insurance policy with basica liability coverage, which is designed to cover damages caused by you, when you're driving.
Each auto insurance policy have limits set on liability payouts, based on the premium (cost) of your insurance plan.
If the damage your friend causes is over the liability limits in her insurance plan, she will be responsible for the rest.
Usually after convicted of a drunk driving offense, the insurance company will cancel the policy and it will be difficult to get a new auto insurance policy.
UK right, sounds like a 12 month ban.
Insurance will pay out but she will probably pay an increased insurance premium when she hits the road again, although I know someone with 3 drink drive convictions 2 x 36 month bans 1 X 12 month, who has no problem with high insurance.
I believe the ban should be both drinking and driving and anyone found drunk during the ban should be thrown in jail
it depends on what they charge with, the attached gives details of the fine limits and penalty points
She will be banned, fined. And in future when she can drive again her insurance premium will be sky high.
life.
