Is clutch a consumable?
Can somebody tell me if I this is true and that I cannot expect the seller to replace the clutch in a car that is rendered unroadworthy 1.5 weeks down the line?
I would appreciate links to your sources when replying to this question.

Unfortunately for you, he's right - it is a consumable, as are brake pads/shoes and spark plugs and shock absorbers (to name but a few).
He might *just* have it repaired at a reduced rate, but I doubt it.
Now, if the front wheel fell off - *then* you'd have a claim against him.
It seems unfair that a dealer can do this, but they have to draw the line somewhere.
by law the seller has to give 28 days period where you can return the vehicle to him.. take it back and steer clear of the dodgy car salesman. i believe it should be covered under warranty, all major components should be, obviously tyres wouldn't.
i agree the clutch is proberbly not covered under warranty .but i do think you would have good reason to return the car for a refund
I have no sources but i have boughten many vehicles in the past with shady warranties.Clutches are not considered a warranty item.Neither are brake pads or oil changes,spark plugs,etc etc.These items are considered as maintenance items and are to be kept up by the owner themselves.A clutch is a maintenance item and will not be covered by a warranty.Sorry.
consumables are normally thought to be items such as petrol and oil.
A clutch is a wear and tear part but can last anywhere between 5000 - permament, one of my cars has done 100,000 on the orioginal clutch.

Point one. A clutch life is dependant on how the car is driven. I have an Audi 80 which has covered 185,000 miles on it's original clutch.However, in the strictest of terms it is a consumable.
But that aside, you have a legal claim against the seller where you bought the car. It was clearly not of "merchantable quality" when you bought it. I would go back and ask him to replace the the clutch free of charge, stating the above clause. If he does not do so, I would threaten to take him to the "Small Claims Court". It is easy to do and the Citizens Advice will help you free of charge.There is a small cost to take him to court, but it is all re-claimable when you win. It is highly likely you would win, unless you have been drag racing in the car.
next time have mechanic check BEFORE you pay.
the wear on a clutch would be considered wear and tear and as a result consumable. If the car was in an unroadworthy state when it was sold to you trading standards would take it up. in reality there is not a lot you can do about it as you would probably have to go to court to get anywhere which could cost as much as a replacement clutch. in my experience if the dealer is dodgy then you should check the VT20 MOT certificate as they are often not legitimate.to check this check the VOSA's MOT database at www.motinfo.gov.uk.
Yes a clutch is considered to be a consumable however the goods supplied to you ie the car have to be fit for purpose and durable.How many miles since you bought the car?I would not be at all happy with a car that presumably has a slipping clutch.Tell the dealer you will take him to the small claims court.Best of luck Mick
clutch is a wear and tear item as with brake linings/tyres.
if it was okay when you test drove and collected the car i cant see you getting anywhere trying to complain.

Dont be confused by merchentable quality that test has been replaced in the consumer protection act 1987, now one should ask wether it is satisfactory quality.
On a £100 car you cant expect such a lot but the answer will be wether or not it is reasonable. That is why you are getting so many different answers.
Would the man on the 8.00am Clapham omnibus consider the terms Reasonable?

user consumables dont fall under the warranty
that includes the clutch ,exhaust ,brakes etc

did you buy on finance or did you pay cash?, if you have it on finance you can get a refund from the finance company, tell them about your problem and what the dealer said. i would go to dealer and tell him you have spoken to the finance and they are going to get your money back for you, this did the trick when my motorbike dealer sold me a dog!! i tried for 3 months to get it repaired, after i threatened with finance company they did it within 2 days, hope this helps.failing this i would shove it up his backside!! maybe then he would be a little more cosiderate.
