Speed Camera van hidden in the dark got me I think..?

am I correct in the following please.
1. They should be clearly visible from a distance of approach by 100 metres?
2. The van had no lights on (it was 8pm last week, so therefore dark) whilst parked in a pavement gap., and it was in an unlit area of road?
This was fact, but the street lights have been fixed since..!
3. I must recieve the ticket on or before 14 days have elapsed?

FACT: It is irrelvant the manner in which you were caught. (sadly)
FACT: This is NOT entrapment - you were not MADE to go faster than the limit.
FACT: Safety Camera vans are NOT required to be visible by law - only the temporary road notice they MUST place further down the street to indicate they are in operation, or the permanent road signs to indicate a monitored area.
FACT: Police speed checks (Not Safety Camera Partnerships) are NOT required to indicate their presence or be visible from the road.
FACT: They have 14 days to issue the NIP (Notice of Intended Prosecution) - but legally there is a 17 day period - to allow for posatl problems.

I have yet to get a ticket mailed to me from one of those things. They catch me all the time. I am wondering if it will all catch up to me one day.
Yeah these bastards have their work cut out to get bonuses these days. Still if they will go out after dark it makes an accident with a high powered rifle while out shooting rabbits that bit more plausible, The fact they got you illegally won't count for nothing.
All my sensible friends got points for speeding but the true speedfreaks are clean,
Not sure but i was caught by one that was not clearly visable and it wasnt until it flashed that i realised it was there,i moved house a few days later and have never recieved a fine.
Why all the complaints about the camera not being visable?
Face facts, you were speeding (obviously), so pay the fine and learn the friggin lesson.

You are right on most of these points. Yes, the OFFICER should have been visible from 100m away. Yes, the Notice of Intended Prosecution (NIP) should be received within two weeks of the offence.generally. I don't think that the lighting of the van is a legal issue.

You have an allowance for speeding. It is +10%+2 MPH. There for 30 becomes 35, 40 becomes 46 etc. Also, if it's a road where people frequently speed on.their target speed may have been 40MPH+.

I would wait, and see if the postman brings you anything. In the meantime.SLOW DOWN !

hi mate. you are right on all the questions.this is entrapment & an easy way for them to make money, i am a truck driver & i have been caught like this before, i took my case to court and it ended up i payed the fine but got off with the points. because the police are supposed to be aVISABLE DETTERANT not a speed TRAP! get leagl advice mate..& a snooper s3 neo..i did its a liceance saver .best of luck
30mph zone, unlit area of road and you were doing 38mph - what if a kid ran in the road? If you had actually stuck to the limit you wouldnt be moaning.
just a small ray of hope !its quite possible that it wasnt a speed trap,,ive seen black vans with two cams up high loooking out from the back, ,,they were number plate reconintion cameras,
and looking out for un insured /taxed,or stolen cars ,,normally they have another car up the road about a mile ready to give chase .
stick to the speed limit, and you will be ok
The best way to avoid them is by driving at the correct speed like the majority of motorists.
If it was at night, the ideal defence would be that The LiDAR devices aren't certified for use at night :-)
