i would get a new one to be on the safe side, as there could be damage that you cant see that has weakened it, so in event of another crash wouldnt protect your child. and yes, claim it as part of the insurance claim and make the other person pay.

I don't think it matters unless the seat has been somehow damaged. You should be able to use the old one. It's not like it's a helmet, or it absorbed some impact, or anything like that.

i asked a police man this question a few years ago and he told me that if its been in an accident then yes you should get a new one as it may have been damaged inside were you cant see and then your baby wont be safe..hope that helps! and yes i think that you can get the insurance to pay for it as long as you say its been damaged.
