According to the news this morning there is a case in front of the european court of human rights at the moment. The case is that by making you tell them who was driving the car, the Police, are breaching your right to silence.
So whether there is a loop hole or not depends on how the court rules and even then you will only be able to use it if you cannot be indentifed from the photograph taken.
ask them if the speed camera/gun was colloborated on the day you were caught, or if someone else is willing to take the points that is also insured on the car. Other than that no
No loop-holes I'm afraid. Lots of Parking loop-holes but it still takes a lot of time (& money) to even work them through the courts.

If the case wins (unlikely), then it would only be useful in cases where the evidence (picture) was taken by a rear-facing camera and you refused to tell the police who was driving .. hence your right to silence!

Dont tell them who was driving the car. That way they can`t fine you. They can prosecute you for not telling them but Hey!.least your license is clean

Not yet, but there are two cases going to the European court of human rights. It is basically because the police are asking who was driving the vehicle when the offence occurred. This is against human rights as the police have to prove a persons guilt beyond reasonable doubt, not getting us to incriminate ourselves. If these cases are successful it could lead to speed cameras becoming obsolete over night.
There is a case being heard in the Court of Human Rights at the moment, where a driver of another mans car was caught on camera speeding, the fine was sent to the owner.
On the notice it asks that the owner Discloses the name of the driver at the time,
Well the owners case is that we have the right to silence lest we incriminate ourselves.
The case is on going so you will have to look out for the outcome.
If he wins his case then Fines will still apply in the case of being caught but there will be no Justification for penalty points.
my understanding is as follows all speed camara enforcement zones are surposed to be clearly identified according to law if not then you may raise the issue with your local speed enforcement department/officer according to the secretary of state however we all have come accross loads of traps and mobile covert units which breech in my view laws on right of the person to know they are breaking the law you can argue well how do we know but a word of warning you may still have to pay really unjust needs every motorist to say this breeches our human rights in any free country jon
