if the car is illegally parked and there are signs stating rules for parking and clamping or removal of vehicles then yes they can. however if the car is being taken by baliffs in antempt to recover costs of outstanding fines etc then no they cant as it is classed as a neccesity item and cant be seized
Yes, Motability users are not exempt from certain parking rules "Fact" but then again most drivers think they should not be clamped even when they knowingly break the law
Simple answer.NO.
They have to abide by the laws, rules and regulations, laid down by the deputy Prime Ministers Office.that is if you live in the UK.
If ever a person was in that position, and it 'was' clamped, then the police could be called, they could remove it, and then arrest the 'so called' bailiff.
no because you do not own that car it is on lease from a garage via the motability scheme they cannot take anything from your home that is on hire purchase either or any personal jewlery , photographs . clothing , or owned by other people ie if somone has lent you an item get a letter of proof of there owner ship to the said item . lmao but here is a loop hole in the law there but i didnt tell you okay .get a letter from somone sayin everything in your home apart for personal items belongs to them and that you are returnig them as soon as you are able to aford to replace them . get boggey recipts from a friend to attach to this letter as proof of there ownership the ballifs cant touch a thing unless they prove other wise that the good belong to you .
I know they can clamp cars and take them as payment or part payment, but mobility not sure they would have to be very cruel to do that,
I always thought that if you gave them an offer of a payment they have to go with that I am not sure have you tried citizens advise?
Hi i think you should listen.. to chrisbell and dosent c. i had the same thing happen on friday and i asked the same question i was wrongly clamp because i bought a car off my neighbour so because it was in the same street they just clamped it..it was my neighbours parking ticket but they tried to get me to pay it ..
Definitely NOT! 100%! Anything that does not belong to the debtor cannot be taken by the bailiff. A mobility car belongs to mobility and as they retain the logbook there can be no denying this. If they try call the police and if they take it report them for theft then claim compensation. They will try to make you think they have powers that are on a par with the police but they have no more power than the average citezen. They are the lowest of the low who prey on the people that need their money the most.
Probably not as you don't actually own it so it's not your asset to remove.
would have thought not mobility has nothing to do with bailiffs
i wouldn't put it past them.
