Small Claims court requires that you ask for payment from the person you intend to take to court before you file a claim. Simply write a letter to the person or company, and very specifically outline your request for payment, and give them all the details and reasons why you think you are entitled to receive payment from them. Send this letter by Certified Mail, and keep a copy of it, so in the event you end up in court, you can prove you previously asked for payment. Don't make it sound in any way threatening, just state, "In the event we cannot resolve this situation between ourselves, I will have no alternative other than filing a claim against you in Small Claims Court." Notify them of how much time they have to respond to your request for payment to you, and if they do not respond, go ahead and file. To find all the info and forms you will need to file, you can type in to your search engine "Small claims court for (your state)" and it will give you all the info you need. Good luck.
Hire a lawyer. Forget the letter. Your lawyer will send notification before the suit is initiated if you request it. This is MUCH more effective and you are more likely to get what you want and not get ripped off.
