Uninsured driver in incident,who thought he was insured and can not pay the claim against him?

unless the uninsured party is willing to pay for damages out of his own pocket, theres not much you can do... contacting the police about the incident may help, but im afraid the police probably wont do much about it. there are legal companies who could persue the matter through the courts so you are not left out of pocket, im not sure how feasible this is, or how good their success rates are. best of luck
U need to involve the police for a start. They can at least do him for no insurance.
Unlikely you are going to be able to claim against him im afraid.

i assume you are the uninsured?if you are under18 in the U.S. your parents will most likley end up with the bill.if you are over 18 the injured party may take you to court but enforcement of the tab is almost impossible you will definatly pay for the next insurance you get bigtime!!unfortunately the old i thought i had payed the bill wont go very far in this situation.if you did pay and were somehow cancelled without being informed the ins company may still have to pay contact the bbb.

Some insurance companies have a "fund" for this but they are few and far between. You could take the guy to small claims court. Failing all this and he can not pay then i am afraid you've had it. Certainly report this to the police as long as it is within 24 hrs.
