Uninsured driver in incident,who thought he was insured and can not pay the claim against him?

do you have uninsured/underinsured motorist cov? if yes- you collect from your own insurance company.
police matter and then on to the small claims court probably end up with a CCJ against them.
You poor thing. If he accepts liability and is not insured and also cannot pay then I am pretty sure you are just left with pursuing him via the courts to try and get the money from him. I hope he is being prosecuted for driving uninsured. Not 100% sure - try speaking to your own Car Insurance company to see what advice they give.
