Court on thursday for car accident am i being paid the right amount..?

I have been offered a verbal of 3200 pounds for whiplash, loss of car and expenses over the past year. My solicitor who is useless has told me to take it even though hes suddenly phoning me. The storage charge for the car is suddenly being put on me for 450 pounds. and they are only offering 1150 on the car whereas i bought it for 1800 3 weeks before that. Is this right what should i do?

The compensation should cover ALL your expenses and inconveneinece.

Anything else is a bonus! BUT consider the discomfort you have from your injuries.

I had a crash and I thought I would die when the wagon crushed my car. Being alive was payment enough for me.

Approach this from the half full angle and try not to feel hard done by at all!

Depends on what that includes.

The offer on the car should be approximately 90% of it's current value. If you bought it at a dealership, you would have paid over the 'street' value of the car as is standard, so the offer of 1150 may be about right.

The offer for your injury - if you are expected to return to normal with 12 months the offer would be £2,600 max (according to my solicitor). In addition to this you may receive compensation for Lack of Earnings (depending on whether your employers continued to pay you or not - if you received your normal pay, this would go to your employers instead.)

There may also be an additional payment for loss of use of your vehicle (and reasonable expenses such as transportation to physiotherapy and medical examinations etc.)

The guidelines for compensation for storage of your vehicle state that it can only be stored for a reasonable amount of time, usually up to 2 weeks. You are then held responsible for the additional charges. Sucks, but that's the rules!

Your offer of £3200 may be about right depending on the level of disability and time periods involved. If you are not working, and therefore you are being offered £2050 for your injury only this is within the guidelines (if your injury persisted for 8-12 months) and your solicitor may be right to put this to you as a good figure.

Remember, if you go to court and WIN, you will only get a maximum of another £550, and it may take you months to get it!

I am in a similar position following a crash just over a year ago, and have just received an offer of £5800 including Car (£2000) loss of earning and serious injury settlement. The driver who hit me was uninsured, so I lose the MIB excess of £500 too. Sucks to be us, eh?
thats **** i would want at least 5k, my sister got whiplash about 8 years ago and received 4k then i would push for more
The judge will look at all the evidence and the precedents presented to him by your barrister and that of your oponents. Depending on the evidence, he or she will decide how much you are entitled to - there are clear guidelines about hwo much you get for whiplash, how much you'll get for out of pocket expenses etc and, if your barrister is any good, he or she will be able to argue the costs up. I have a similar case pending as I was smacked from behind when I was on my motorbike and my solicitor says a case like that usually get between £5000 - £8000, depending on the extent of your injuries. I would get yourself a new solicitor.

Mind you, mine aren't great as my case has been going on for 2 years and they still haven't sorted it! I think the insurance companies deliberately give you duff solicitors to save themselves money!
