I just got given a parking ticket, am i going to be able to challange it? And will i win?
any chance of getting it over turned, or am i best off paying it early and getting only a 30 quid fine?
Answers:
If the ticket has the relevant info, you could phone and ask politely if they would reconsider if you can show they made an error. However, the rules usually say its up to you to display the ticket clearly so I personally woudnt push it
you could try , but they could say it was not displayed.
Pay the fine. It will save you a load of anguish later, mate.
In the US, my friend challenged a parking ticket he got because the no parking sign was stolen (it was on a college campus). He won and got the ticket overturned. He got another ticket for the same spot after they put a sign back up and paid it in pennies. He told me that meter maids eat their young once.
Present the valid ticket to the court, explain that you'd already paid to park, and ask the court to dismiss the parking citation.
The government only cares about money, if you can't proove it, your in for it. I have had enough tickets, trust me, it's you word against the officer and judge, they want your money.
Why did you leave the car window open - were you not afraid the car would be stolen?
Depends on how lenient the council are. You can try appealing but, even though it wasn't clearly displayed they might believe you if you can produce your sticker. If no good pay up early to avoid extra penalty and learn by expereince. I wouldn't have left my car window open anyway....
You probably won't win. It has to be displayed a certain way to show the time and date to prove its a valid ticket. Anyone can display a piece of paper.
If you've still got the ticket you might have a stronger case.
Next time put the ticket on the car next to yours. Good chance they will pay it for you.
Mail in the parking stub and fight the ticket to hell freezes over. Claim the parking receipt was correctly put on the dash and the meter-maid is a liar. Take a photo of the stub correctly placed on your dash. Make sure you reset the date on you camera so it will display the date of the ticket. A picture is worth a thousand words.
If you can do it in writing fight the ticket in some language other than English. Liberal courts don't like to pick on minorities.
if it was not displayed properly ,they take a photo now as evidence that the permit was either not there displayed or was positioned wrongly, sorry just pay the thirty quid and ensure your permit is on display properly to avoid any more tickets.if you appeal it will only get dismissed,.
ask around your jurisdiction; you'll gain wisdom from asking someone involved with law enforcement or the motor vehicle department or other drivers.i got verbally blasted by a policeman collecting the fines at traffic court outside the courtroom because i pleaded guilty instead of guilty with an explanation.always a lesser penalty
that happened to me,but luckily the traffic warden was still there,so i shown him the ticket, and he wrote the number down.if you wasn't there when the warden put the ticket on,you could still challenge for the simple reason that the ticket has a time on it and so does the fixed penalty ticket,if they both tally you have got proof of a valid ticket, even better if you had to put your registration on as well.
Complete the 'challenge PCN form' take the valid ticket with you, and all the details of the fine etc, and go to the council's public access point. Explain the situation, and you may well 'get away with it'. If not, take the opportunity to pay it off early while you are there. Be polite, courteous and say thank you and I reckon your chances are pretty good. You'd best get on with it though - there's a time limit for challenges.
You will be better off just paying the ticket because once a cop gives you a ticket it is almost impossible to fight it. You can try but 99.9% of the time you will lose.
being fined before being found(or assumed to be) guilty of an offence is a contrevention of the human rights law and can be overturned on the basis of it being illegal to be found guilty without a trial .if you sign the ticket you are admitting to the offence and have no leg to stand on ,leave the tiket un signed and send it back challenging the ticket.you will always get off as they cant be bothered to show up most of the time.they would need evidence of the crime to prove your guilt ie a witness or photographs to show no valid ticket, innocent unless proven otherwise they say, hope this helps.
Pay £30 and learn by your misfortune.
In simple terms NO. It's a "PAY and DISPLAY" contract that you enter into. Much like your road tax - it is the failure to DISPLAY that is the offence.
If no ticket is visible, or is purposely obscured then they have the legal right to issue a penalty notice. Do note that only COURTS can issue fines, civil authorities and their agents can only issue penalty notices. They can and will pursue them through a civil court action - and win most of the time.
Having a ticket for the date & time is NOT a defence in their eyes as you could have simply found it.
Sorry I can't be much help.
you could try and challange it but 9 out of 10 you would lose they would increase the fine.if you do decide to fight them all i can say is good luck
