How do you appeal against a parking ticket you feel has been unfairly issued?

We parked on double yellow lines but there was a notice saying no loading at anytime. We did not think that applied to us as we were not loading anything. We had our disabled badge and time clock showing and were not causing an obstruction. When we returned 30 minutes later we had been issued with a parking ticket.

Ring the number on the back of the ticket and plead your case to the supervisor on duty. If that gets you nowhere, they will give you an address to send a letter of appeal to. As a disabled badge holder, you should not get a ticket for parking on double yellow lines unless you are causing an obstruction, or the disabled person to whom the badge was issued is not present.
You must approach your board of city or city council to appeal for a parking ticket. You can also send them a formal complaint online or by snail mail.
it should have a telephone number on your ticket and an address write to them and tell them how you feel and it should be quashed but i think you have 21 days to do so

they use the term no loading to cover a multitude of things, this means they only have to make one sign. It also means no waiting or parking and i am afraid that having a disabled badge does not cover you either, it is a little clearer in London where they actually use RED lines and enforce it as a tow away zone.
You wont get let off this one i am afraid, and i have collected many over the years as a self employed courier. Sometimes i am only stopped 2 minutes but am told to move or be booked.. money is all they are interested in.
It is your right to have your voice and appeal heard on the dete set for you in traffic court. Take with you all pertinent documentation, and make sure that any witnesses on your behalf are there with you.

There were two disabled people in the car but they would not recognise the second disabled person as a witness because he was not an INDIVIDUAL witness. Thats laugh isnt it? (My husband didn't know they had just changed the length of the yellow light to a shorter time, and was going too fast at the LEGAL speed to suddenly slam on the breaks - which would have caused a car wreck involving other cars - he judged it was safer to continue through.)

We wrote all the facts down clearly and in detail, included what was going through our minds that caused us to make that judgement call to go through the light, got it notarized, and sent a copy to the court in an appeal. They dropped the charge!

Just make sure that you write down everything in excruciating detail and in chronological order, and also in NON-inflammatory language state that the notice posted was very ambiguous and unclear - you weren't loading, so how did it apply to you? And it was the burden of the people responsible for the notice to make sure that if they meant NO PARKING at any time, they should have put THAT on the notice. Therefore it is the burden of the court to prove that you were actually breaking any laws and innocent until PROVEN guilty.

It sounds to me that you were parked illegally because the double yellow lines and no loading sign would indicate no praking either. if you want to contest it, fill out the back of the ticket stating that you want to take it to court. You will have to show up in court and miss work, eating up valuable time, but there are two ways to approach it at that time. One is to plead not guilty and explain that it was not marked no parking. if you want to try that be SURE you have researched the law on this. Go to at least two police stations and ask the officers on duty about the situation, but do NOT tell them you got a tciket. Ask them if you could park in an area marked that way with your tags. Make a note of the names of the officers you ask. I'll tell you that I think it unlikely this will work.

The other option is to plead guilty and ask the court for mercy. Explain how you misunderstood the markings. Point to your clear driving record (I hope you ave one, because if not, this won't work). Explain that you have learned and will park appropriately in the future. I did this for a ticket I had gotten (illegal u-turn) and the judge 's verdict was probation before judgement, meaning I did not pay the fine, got no points or permanent record, and probation for 18 months. Stay clean for that time and you are all clear. Some courts make you pay court costs, but depending upon the cost of the ticket, these can be far less (my $0 courts fee was far better than an $85 ticket with 2 points).

One last piece of advice. if the cop that wrote the ticket does NOT show in court, pleade not guilty right away. Without a witness for the prosecution, the judge dismisses it immediatley.
Go to the site of the incident and take photos of the area as well as the sign. Go to court armed with the evidence. Plead your case.No loading does have many definitions so yours is indeed one of the definitions..It's worth a shot..Good Luck
