Insurance Claim on double yellow lines accident - am I liable?
Thanks for your help. N
Answers:
yes you are responsible, the fact he was in an area where parking is not allowed has no bearing on the matter.
Think your self lucky, it could have been a truck there unloading, which is quite legal on double yellows
Yes, you are. The car is negligent free.
Yes you are, you reversed into him, so all down to you.
Yes you are Liable..Yellow lines are indication to enforce a rule. Would you be liable if the car had run out of petrol or broken down!!
You will be held at least partially liable, because you were there. But, you should fight some because the car was illegally parked. If he received a ticket for being illegally parked, you have better odds.
yes you are
sorry mate, down to u i am afraid as u backed into the other car. The other car may have a disabled badge in which he/she is allowed to park on double yellow lines for 3 hours.
yes you backed into a parked motor sorry but is you loss
The fact that the other vehicle was stationary makes all the difference, double yellows or not.
If you were both moving then it would probably end up knock for knock but as you described it then it will be interpreted as you either driving without due care and attention, or driving without due consideration for other road users.
Plus a parked car could just as easily have been a pram or a wheelchair going about reasonable business.
You are definately liable for all, there will be no apportion split.
I know, cause I done a practically identical reversal with the same results years ago !
Did you hit the other car?
Does the fact that he was ilegally parked give you permission (or in this case, a pass) to drive into another vehicle?
Damn.
Unfortunately, the other car's position makes no difference as it was parked. Although it was parked in an unusual place, this could be likened to rolling over a trashcan in the road. The other vehicle is a stationary object. You bear the greater duty to make sure the path was clear before backing. You will be found 100% negligent. Hopefully since you were likely going very slow, the damage is minimal.
Yes, you are. All very well to say, he shouldn't be there. It could be the car had broken down giving the driver no choice in the matter.
If the car is there to be seen, you are at fault for striking it. The illegally parked defense works nowhere. Sorry.
You are liable.
