When ahackney carriage is not working does it by law have too have its top sign still on the car?

No. If they have permanent signs they are supposed to be unlit when the cab is unavailable for hire. You'll find that quite a number have signs with magnetic bases so they can be put on and taken off to suite.
From when my dad used to drive a hackney licensed car all he had to do was make sure the "for hire" sign wasn't lit. As far as I know the taxi sign on top could still be lit, it's a valuable advert.
