Can i claim for a compensation if I fall from the bike when riding on a defective pavement ?

I was riding slowly my bike on a pavement in a residential road in Wales, when I put the wheel on an apparently closed manhole, but the cover was not fixed and my bike felt into the opening and i crashed into the pavement´. i broke my left arm. the police came and said that i should not use the pavement to ride bike. can i still claim for money because of missing road maintenance?

Answers:
You're not allowed to ride on the pavement - you should have been on the road! Your compensation is not being fined!!
I sincerely doubt it. Who knows though?
don't think you have a leg to stand on my friend! You should be on the road anyway!
Not likely, at least not on the first try.

Here is what applied in a situation I was involved in: (This was in Chicago. It may be different where you live.)

After reporting the incident, provided the "defect" is a real one (like a pothole, not a crack) the city is obligated to make repairs to the pavement.

If you then experience another incident at the same site within a "reasonable" amount of time (which again, would likely vary depending on where you live), you are then entitled to compensation.

If you're riding somewhere you're not supposed to, then you're probably screwed. It's not impossible that you're still entitled to some kind of protection however, so you could give it a shot.
Get over it. Wear safety gear and learn to ride properly. People need to take responsibility for themselves and stop blaming others.
You are not allowed to ride on the pavement. This annoys me more than anything - ride your bike in the road in future. Pavements are for people.

I'm sorry you fell off - but I sincerely hope you don't get any compensation. You should not have been on there in the first place.
no way, i daresay there was a sign saying no bicycles
No because you were riding on the pavment and not the roadway.
Pavement in for pedestrians, Roadway is for vehicles such as cars, vans, BIKES etc..
Sorry but you would be wasting your time.
If you can show that the local authority have not maintained the manhole cover, then you have a claim. Take a photograph of the cover and take a witness statement from anyone who might have seen it happen
You were riding on the pavement which will cancel any chance you had of a claim xx But having said that, people do get stupid amounts of money in compensation just for someone looking at them wrong so go for it!
yea like the woman who got nearly 1 million for being called names like the playground bullies call you
eg smelly and that

if you can prove it then maybe but i dount it asyou were not ment o be on there
You could try, but as you were breaking the law at the time (riding on a public footpath), the council / local authority may ask the police to charge you with several road traffic breaches.

I think you should just learn your lesson, and TAKE RESPONSIBILITY FOR YOUR OWN SAFETY, instead of blaming somebody else for your stupidity.

Wouldn't you agree that it is wrong when a burglar claims for compensation because you assaulted him in your house or gets health & safety involved if he falls down your stairs in his 'unsafe workplace'.. you are no different trying to claim compensation whilst carrying out an illegal act.
Nope, gouvernment covers their asses on that one. Law says they cannot be held liable. Private ground would be a whole different story however.
i really doubt it as U shouldn't be riding on the pavement anyway, y not phone one of the injury layers that U see on the television, and ask them, that would be Ur best option
I should BL**DY hope you are charged for breaking the law.
Of course you can apply for compensation but NOT if you tell them you were riding your bike on the pavement as this is breaking the law!

Best thing to do is tell them you were walking on the pavement when you fell down the manhole then take em for every penny, atfterall you'll only have to use the money to pay the extortionate amounts of council tax they charge us!
only if was a cycle lane other wise could be hard to get compensation ring one of the no win no fee companys they can tell you either way if you have a case
You've got no chance of claiming anything. I'm amazed the police didn't charge you for illegally using the pavement. Pavements are SOLELY for the use of pedestrians.

Bikes shouls NOT be ridden on pavements.
You should have been in the road not where people walk if I understand you correctly. If you were indeed in the roadway where you were supposed to be you may have a case. I would seek a lawyers advice.
You shouldn't be riding your bike on the pavement. Pavements are for pedestrians so you shouldn't be able to claim any compensation. Nobody owes you anything. However, if you had hit a pedestrian, you could be sued for compensation. Shame you didn't really. It would teach you a lesson.
I am sure you can.
The fact that you are breaking the law really shouldn't matter as everyone knows that should something happen to you, some greedy grabbing smart *** will always find a way to make money at the expense of the majority of the population.
Why not go for it and just add to taxes the rest of us pay.
Should also be able to claim for "distress" cos police told you something you didn't want to hear.
I see it happened in Wales, claim the language confused you.
Try "human rights" card. Discrimination against pavement riding cyclists. etc, etc, etc! Why not claim riding on road has caused you trauma! That usually is worth a few thousand.
