Are speed camera vans legal?

It doesnt matter how they get a motorist, they cannot be questioned and the evidence they collect is NEVER in question? If they break their own "guidlines" they just cant collect their fee for that conviction. That cant be right , is it?

As long as the authorities aren't coercing you into speeding (a dare, perhaps) anything goes. After you're popped a few times and your insurance rate goes through the roof, you'll realize that "The Law is NOT for breaking."
If you can prove that a speed camera van broke the regulations regarding their use, then you can have a speeding fine revoked.

Fairly hard to do, unless you want to go to court to contest a speeding fine, or know the regulations quite well.
Your "european rights" say that you do not have to admit to a crime that you may have commited, the Police have to prove it was you.

If there is no photgraph of your face, how can they prove it was you.

Of course they are legal otherwise the courts wouldn't accept the photographic evidence they produce.

However, there have been several cases where photographic evidence has been successfully challenged. Normally where the procedure for testing the machine at start and finish of a session has not been correctly documented.

The evidence WILL stand as legal is the measuring equipment was operated correctly. When the van was is of no concern, even illegally parked vans can still be used.

It is the measuring equipment (LTI 20-20 normally) that the evidence is based on - not van location.

Deny everything, take them to the highest court in the land,tell them it definitely wasn,t you and the whole thing smacks of conspiracy,then just pay fine and get 3 points.

In most states/countries that use cameras, a law is passed to allow automated traffic enforcement. So then the question becomes one of disputing the accuracy of the citation. You might dispute the maintenance of the camera, the driver of the vehicle (if it wasn't you), but there is usually no dispute on the location of the van or camera.

As a driving school instructor, I have heard people complain that they were tricked into driving too fast (How?), the cameras violate their right to privacy (which you do not have on a public street), and that they cannot front their accuser (which is wrong - the police department is the accuser, not the camera, so when you appear in court, you can confront the representative from the police department), and that they have to sign for a ticket to receive it (no, you don't).

What it all boils down to is that people got caught and they don't like it. I actually prefer the cameras, as they are more accurate and more objective than an officer, they allow the officers to do other things, and it is easier to determine the accuracy of a mechanical device than it is a human's perceptions.

So, if you don't like the cameras, don't speed or run red lights and you won't have a problem! But, if you choose to do either of those things and get caught, be a responsible person and deal with the consequences. That is what being mature is all about!
