Car has 17" wheels the spare is 16" if I have a flat and run with the 16" is this legal?

Not only is it illegal its downright crazy. The car will have no balance especially if its the front wheel on a front wheel drive as this will have a drastic effect on the steering when cornering. Don't do it.
yes it is legal, just be sure the spare is properly inflated and get to the tire shop asap

yes thats fine some cars have a spare that is way smaller than stock. I got 26s and my stock 17 is what i have for a spare
Join the AA or RAC and don't take the risk. Get them to tow you home if necessary.

Depends on the size of the tyre. You can have 16" wheels with slightly bigger rimmed tyres to the overall effect is the same size overall. I wouldn't have thought it was very safe otherwise - just look at the penny farthing bikes with the odd shaped wheels!
It's probably a compact tire - takes up less space in the boot.
They are legal, but you shouldn't go over 50mph, and get to a tyre fitters asap.
cant be illegal cos in my vw have a space saver for a spare and its 2" smaller than normal wheels, although stated its only to get you to a garage and must not exceed 50mph. guess it would'nt be a comfy ride though
it is fine the reason why they do this is that when you get a puncture you,l get it fixed straight away.you cant go over 50kph(31 mph)
If its the spare belonging to the car then its OK
but get to a garage asap, also make sure check the tyre
pressure from time to time to check that it is not flat

Perfectly legal. Ever seen a Volvo spare tyre for example? It's about 2/3 the size of the normal one. I have 18" wheels and have a 16" spare which poses more of a problem, that the car will lurch to one side, but as yet, have never had to use it. 17" & 18" wheels generally rarely puncture because of they're wider grip and surface area.
YES, BUT NOT SAFE.IF FLAT IS ON FRONT THEN THE CAR WOULD PULL TO THE SIDE WITH THE SPARE.
