From my experience with the legal system, if there is no evidence of what happened, there probably won't be nothing done. I was injured at work by a piece of steel that was faulty. It disappeared shortly afterwards and I consulted a number of lawyers. I hope you good luck.
First of all, I would get a lawyer to represent you as I believe you have a legitimate case.

If you want a cash settlement threaten to go public with the whole experience. They will pay you instead of having their name drug thru the mud. Keep in mind you will NOT win in court!! They have way more money to prove you wrong then you will ever have.. Settle it out of court. It is the only chance you have of justice..
No theme park is all magic, they are cities unto themselves.

You really should have gone to the first aid station and made them take a report down. First aid stations hate taking down reports but you can intimidate them into doing it. Most are young teenagers/young people with a basic first aid course and possibly CPR , they are used to handing out an occasional bandage. If you don't have any piece of paper that verifies the incident it will be impossible to take it to court. You also have no witness's or the name of the guard who took the canister.

However, I would write to their Public Relations people and tell them of the incident and include all the details. Make them know. in no uncertain terms. you were not pleased with the way it was handled. Public Relations does not want their theme park to have a bad rep or even the hint of one, so you should get a reply within weeks. Find an address for Florida's theme park they are very separate from Anaheim even though they have the same name. Trying writing a letter to them, because if you go to an employee there is no guarantee it will be kicked up stairs.
the asker didnt say anything about suing, but people bring it up anyway! if there was no damage on what grounds would you sue?
i agree you should write them and let them know so it will hopefully not happen again. they are very concerned with safety but ofcourrse accidents can happen anywhere/anytime

I was injured on the autopia ride. seriously, I have a ruptured disk from when someone rear ended us.
I went to first aid and made a report, then later had to go to the hospital.
I have permanent damage, and even though this happened 9 years ago, I still have pain.
NO attorney would take the case, and when I finally found someone who said they would take the case their advice was "we can do this, but we will probably lose up against their attorneys and if we win I'll take 60% because it will be a long and laborus trial."
I know I'm not the only one that this, or something similar, has happened to, but they are such a large entity with big money attorneys behind them, theres no fighting them.
I'm really glad no one was hurt with your situation, and I understand your frustration, but there really isn't anything you can do.
We represent dollars to them, not human beings.

has a complaint for disneyland paris not as serious as yours though..got told by disneyland staff to report the complaint to my tour operator which i did..the answer i got back was since i didn't complain by using the complaint telephone number on my tour package documentation that my complaint will not be held up.moral of that story if you didn't complain at the time of the incident you have not got a leg to stand on.goto www.disneyland and see what complaint procedures they have..have you any proof this happened because if you have not its going to be very hard to complain hope the kiddie was ok but remember if anything happens like this again complain straight away
