My neighbours chimney is causing damp in my room were do i stand legally is it me or him who has to fix it?

Check the deeds to make sure it isn't a shared chimney.

Firslty i'd recommend that you contact your neighbour to let him know of the situation.
Inform him that you intend for a builder to come in and check out if the chimney is causing the problem, the extent of the damage and all costs involved to repair your walls.

If its not the problem then you should pay but inform him that if it is his property causing the problem then you intend to claim on his buildings insurance and ask him to look into it for you.

Being diplomatic will ease things between you and your neighbour.

I guess he wouldn't be too happy to get a bill dropped onto his door mat and thats the 1st he's heard of the problem.
PROBABLY THE OWNER OF THE BUILDERS RESPONSIBILITY YOU CAN DO A QUICK FIX YOURSELF BY RE CAULKING THE FLASHING AND CHECKING THE SHINGLES AROUND IT.
just go round and tell him the problem ..if all fails and he ignors you just beat him up and still tell him hes paying for it !!
well, that is considered a nuisance. it interferes with your right of enjoyment of your premises. you can demand them to fix it but dont expect them to act on it asap. you should give them a heads up that this is happening and ask for a reasonable time frame for them to work on it.

It sounds as if he is running a gas fire without a metal flue and the water is coming from the products of combustion of the gas. It also means it is allowing CO2 to enter your premises.
Ask him if he has a gas fire and if yes tell him to stop it, if he doesn't inform H&S.
