How do i find out who his responsible for a tree barrets say not theirs council say not theirs?

you need to find out who owns the land the tree is on. Check with the land registry.

A tree is the responsibility of the landowner the tree is growing on, this would also apply if the tree is unsafe, like lohad said check the land ownership. If the branches on the tree ovehanging property is the problem the owner of the adjacent land where the tree is overhanging, is entitled to cut the branches off where they overhang IE on the boundary line, however the branches and any fruit are still the property of the owner of the land the tree is on and must be returned. Good manners would dictate that the owner is contacted before the work, if possible and offered the branches rather than chucking them over the fence onto the prize petunias.
you need either citizens advice bureau or a solicitor. The land deeds will show who is responsible for that area and therefore for the tree. Good luck. Is there anyone you can speak to at the council legal dept that could tell you where to find this information cheaply. If the tree fell down now, someone would be held responsible within an hour or so.
