A builder put his foot through our ceiling, rain damaged carpet whos insurance do we claim from?
Answers:
If he is a reputable builder, he should have his own insurance to cover personal and property liability. Secondly, I recommend you speak with your own insurers and explain the situation. They may recommend filing a claim and they may then persue recompense from the builder on your behalf.
the builders, he is liable to repair the ceiling and the carpet, consumer credit act 1974 as amended if you live in the uk. good luk
Being a homeowner and retired home service business owner, I can picture too many different ways that this could have happened. To answer this question intelligently, we need to know the circumstances in how the carpet was water damaged, because a "ceiling" was stepped thru.
All reputable contractors, home service companies, etc, carry liability insurance in the event a home is destroyed thru their actions. Therefore their insurance may not cover just 'carpet damage'
If the damage occured because of neglect. neither insurance company may accept the claim.

The builder should carry adequate insurance to support this claim. Check with his company and file a claim with them.
The builders liability insurance should cover any damage.
Not knowing where you are located, I'll use the USA as an example.
In this country certainly you need to confront the builder, but also your own home owners insurer. If the builder won't oblige repairs, your own insurer might take on the claim and in the process they go to the builders insurer for recompense.
The process is called subrogation.
If all else fails you can go through the small claims court system, though that could take eons in any resolution.
