Do i legally have to pay this money?

I recently bought a new bed, before i bought it from the shop i told he sales women that i have been needeing a new bed for a while and that i have a bad back, i told her my budet and she sold me the one i liked. It got delivered the next day, that night i couldnt sleep on the matress as it was so lumpy and i had springs stuck in my back and ended up on the sofa.
Two men from the factory came to look at the bed the next day and said i should not off been sold the bed in the first place as it is only meant for occasional use and not for every single day, they told me they would pick the bed up in 2 days and put more stuffing in it, but they are saying it will cost £25.00. But i dont see why i have to pay this seen as i have to sleep out for two nights plus spend one on the sofa, what do you think

Answers:
you paid for a bed to sleep on!!...the item is not suitable for the use it was designed for..therefore the item is faulty!! and should be replaced or money back under your rights as a consumer!

my elves could make you one in time for Christmas if you want!!
Wow. Sorry, but we Americans have a 'no sale is final' policy. They're going to re-stuff your mattress? That's f'in crazy. No. You shouldn't have to pay.
tell them to feck off and also you are a wee bit prone to psising in your sleep and you wont see them for the dust
Not sure from a legal point of view...but no way, surely not!
I would kick right up, This so annoys me nowadays! you can't buy anything without their being a problem! That silly woman just wanted a sale out of you! Depending on how cofrontational you are either go into the store armed with your right for answers and a free bed stuffing etc.. Go to the trading standards website and as for some advise as they are excellent for all types of queries!

Is it a huge store? Do they have a head office you can contact?
If I was in your position, I ask the shop for a full refund unless they replace the bed with something more appropriate. If they refuse to do that talk to the manager and take it higher and higher up the scale until someone does something for you.
If you are happy to have the bed restuffed go for it, but don't pay for it.
The item wasn't fit for the purpose for which it was sold so you have every right to ask for a full refund and if they are doing something to make it right you don't have to pay for that.
that's the difference between sales and service..

the people at the sales dept will give you anything and then they feel no pbligation (morally or legally) to look after you when you get any problem later on.

I guess you need to go to the place you bought this bed from and launch a complaint.

don't kknow about legal terms, but morally you should NOT pay them a penny, rather they should be paying you damages.
Yeah the occasional ones are the cheapest and lowest quality, they sold you the wrong bed in the first place, not suitable for a bad back, you needed something like memory foam, tell them you want an exchange for a decent bed and threaten them with the local Fair Trades office if they don't do a good deal.
You should contact your Trading Standards Officer who will be only too willing to help you. If you call your local council offices, the receptionist will give you his number/extension. I've recently contacted Trading Standards and was very satisfied with the help I was given. This is the best course of action as you will be given details of your legal rights on this issue. Good Luck.
No way - who'd buy a bed that was for 'occasional use'? Even a bed in the spare room you'd want it to be comfy for your guests!!
Send a letter containing this to 'trading standards' (phone book or internet) they will send you a letter that you can send to the bed company, this will probably then get sorted.

Good Luck
telephone and write to the manager of the store, tell them what happened, demand a replacement bed or full refund.

If they refuse consult a solicitor to write on your behalf - asking for full compensation, plus legal expenses. I doubt if it will have to go to a small claims court, if it does you get all costs awarded by the court.
Bit of a dodgy one this. Under the sale of goods act 'an item must be fit for the purpose for which it was designed' It is a bed and fit for that purpose unless the matress is faulty or badly made. Unless it says on the the matress that is orthopedic you may have a problem but I suggest you go back to the shop and try to come to some arrangement failing that speak to citizens advice. Good luck.
Is the issue here the bed ? or the mattress ?

If it was me, I would not pay the extra , thenI would demand the bed be taken away and my money refunded in full.

a bed for "occasional use" doen not sound fit for purpose in any way at all !
Tell them its not fit for the purpose it was sold for. You told the sales woman what you needed. Google the "sale of goods act 1994".
Quote them the "sale of goods act 1994". they should an item that is fit for the purpose it was sold for, this clearly hasnt happend in this case so therefore you are entitled to a full refund, stand your ground and dont take no for an answer, if they dont comply report them to trading standards
Telephone your local Trading Standards Office and tell them the problem as soon as possible. They will give you very good advice but do not delay.
If you're in the UK you should contact Consumer Direct - they will inform you of your legal rights and advise you what action you can take.
