yup, welcome to Merry Olde England. It is now a crime to do anything that could be considered "inciting racial hatred". He could have been shouting at a brick wall, but if he was calling it black/green/brown/othercolour - he's guilty.

There is a "victim", The fact that she has not come forward, or found, does not make her any less of a victim. The witness is also a "victim" as who would want to hear that sort of racist abuse. If he is guilty, would you approve of him ranting and a woman in such a way ?
Lets assume that he was Innocent.
Why would a self respecting witness bother to take the time to follow him, take down his reg and go through a court process ?
Now, look at his picture, make up your own mind. I know who I would believe under oath in a court of law.
He may think twice next time before spending £400 !
