Are you flying on airline that is Spanish or US? That governs the laws. And yes, if you are of legal drinking age you most certainly can drink on the plane if they offer alcoholic beverages.

I think the legal drinking age is goverend by which country the airline is from. eg if its Spanish, then probably 18, or if its American 21. If its neither, then i think it depends on when you enter US airspace if the age goes up?
Yes it definately depends on the airspace you are flying in. My friend left New Zealand where the drinking age is 18. He was 20 and asked for a beer, the stewardess asked him how old he was, and when he said 20 she said sorry we are in US airspace now and brought him a glass of MILK! lol.
If it's not an American airline though, you might get lucky and not get asked for ID especially if you look 21 or so. Just remember to drink plenty of bottled water if you will be drinking or you will get very dehydrated while flying and drinking.
